HHS Releases Proposed Rules on ACA Implementation

On November 20, 2012, the Administration issued a series of proposed rules to implement the Affordable Care Act (ACA). The proposed rules address the following topics:

1.    Prohibition on discrimination based on pre-existing conditions or a chronic condition beginning 2014 (i.e., insurance market reforms)–additional information, including a link to the proposed rule, can be found here.

2.    Essential health benefits, actuarial value, and accreditation–additional information, including a link to the proposed rule, can be found here.

3.    Expansion of employment-based wellness programs–additional information, including a link to the proposed rule, can be found here.


The proposed rules will appear in the Federal Register on November 26, 2012, and provide for a 30-day comment period on the EHB and insurance market reform proposed rules and a 60-day comment period for the wellness proposed rule. ECFC has begun to review the rules and will provide additional analysis over the coming weeks as it prepares to submit formal comments.
