Legislative Update: House of Representatives passed H.R. 1270, Restoring Access to Medication Act

On July 6, 2016, the House of Representatives passed H.R. 1270, the Restoring Access to Medication Act, which would overturn a provision of the Affordable Care Act that prohibited flexible spending arrangements (FSAs), health reimbursement arrangements (HRAs) and health savings accounts from reimbursing the expenses for over-the-counter drugs and medicines.  The bill would provide that reimbursements of over-the-counter drugs and medicines would be permitted after December 31, 2016. 

This bill, which was passed with support of 10 Democrats will next head to the Senate for consideration.  It is unlikely that the bill will receive prompt consideration in the Senate.  However, we would anticipate that this bill will be in the mix at the end of the year as Congress looks to pass end of the year legislation in a lame duck session.  We will keep membership informed about the status of the bills throughout the year.
